Tensing Retrial Day Two

Live tweeting of the second day of testimony in the Ray Tensing retrial for the shooting death of Sam DuBose during a 2015 traffic stop.

  1. Per courtroom staff: Attorneys are in chambers, still waiting for proceedings to begin. #TensingRetrial
  2. Ghiz: We may go long today since getting a late start. Starting today with DuBose's fiance Dashonda Reid #TensingRetrial
  3. Reid had a suspended driver's license, she didn't know til July 2016. DuBose driving her car, so plate run showed her info #TensingRetrial
  4. Reid: the car had bad breaks, had to keep foot on gas and break. #TensingRetrial Defense up next to Q Reid.
  5. Reid asked if she's been convicted of making false statements. She doesn't want to answer, says has made bad decisions. #TensingRetrial
  6. Mathews is trying to discredit the witness. Judge instructs her to answer the questions, she's being evasive. #TensingRetrial
  7. Mathews asking Reid who owned things in the car such as cell phones and pot. #TensingRetrial
  8. Mathews asking about meds found in car. During 1st trial DuBose's med records were excluded. Prosecution objects, sustained. #TensingRetrial
  9. Reid asking to stay in courtroom now that she's done testifying. They're checking if there is space. Judge says cap is 50 #TensingRetrial
  10. Next witness is Alicia Napier, she was in the car in front of DuBose's at time of shooting. #TensingRetrial
  11. Napier: upon seeing PD, DuBose car just thought it was a regular traffic stop. Sat there for a while w AC on. #TensingRetrial
  12. Napier: was looking in rear view mirror at first, then switched to side mirror when Tensing was approaching DuBose's car. #TensingRetrial
  13. Napier did not know DuBose or any of his family, nor Tensing for that matter. #TensingRetrial
  14. Napier: I thought at first Tensing was shot bc he fell back. Then the car sped off so she ducked down and heard acceleration #TensingRetrial
  15. Napier: originally thought heard a second shot after the acceleration while she was ducked down. Then saw cops running by #TensingRetrial
  16. During trial #1, Ms. Napier acknowledged she watched Mr. Tensing's body cam footage on YouTube. Mr. Mathews really keyed on that point.
  17. Napier: impossible for me to hear Tensing/DuBose convo b/c windows up and AC on. #TensingRetrial
  18. Napier reasserts she heard a shot, saw Tensing fall back, then car moved to the center of street. 100% sure shot then move. #TensingRetrial
  19. Napier on why didn't contact PD right away: I was scared, I didn't want to be involved. Gave statement later that night #TensingRetrial
  20. Napier watched the video on her phone. She's in tears describing watching it with yelling "stop stop" and seeing shooting #TensingRetrial
  21. Napier says now knows second "shot" she heard was car hitting the guard rail. #TensingRetrial
  22. Napier says the whole situation took at least seven minutes, she'd been in car for five minutes b4 started. #TensingRetrial
  23. Mathews questioning Napier, working toward suggesting she was preoccupied with kids and not a reliable witness #TensingRetrial
  24. Napier's testimony is a little confusing, but she keeps repeating that she heard the shot then saw the car move. #TensingRetrial
  25. Ms. Napier acknowledges she couldn't hear squealing tires (if there were any) b/c her widows were up & A/C was on.
  26. Napier: Tensing was already on the ground, he wasn't attached to the car at all. #TensingRetrial
  27. Napier is finished testifying. Prosecution calling CPD Officer Kimberly Horning #TensingRetrial

  29. Purpose of Horning's testimony is to say she made scale diagrams of the shooting scene. Those are used to dissect what hapnd #TensingRetrial
  30. Mathews beginning cross of Horning asking about a no parking sign at the scene. #TensingRetrial
  31. Court taking a 20 minute break. Will likely hear from CPD Officer Shannon Heine when return. #TensingRetrial
  32. Court back in session, CPD Sgt Shannon Heine taking the stand. #TensingRetrial
  33. Sgt Heine conducted the CPD interview with Tensing after the incident. #TensingRetrial
  34. Heine: the attempt was made it identify the man walking up the street (seen in video) but he was never identified. #TensingRetrial
  35. Heine: There was a camera on a house and we got the video but it didn't capture the incident. #TensingRetrial
  36. Heine: UC's policy was such that I couldn't interview Tensing for several days. (At which point he'd already seen the video) #TensingRetrial
  37. Heine: CPD doesn't want a "compelled statement" so officers don't view their body cam videos before making statement. #TensingRetrial
  38. Heine also interviewed Alicia Napier, who had not seen any video at that time, #TensingRetrial
  39. Prosecution will now play Heine's interview with Tensing. As I recall it lasts at least 30 minutes. #TensingRetrial
  40. Heine interviewing Tensing along with another officer and Tensing's union representative. #TensingRetrial https://t.co/HgDkcgVbez

  41. Tensing keeping eyes closed & head turned away as the courtroom listens to him explain the shooting. Just wiped at one eye. #TensingRetrial
  42. Tensing in video: I was hanging on for dear life when I fired the shot. #TensingRetrial
  43. Tensing in video: I didn't detect the smell of drugs or alcohol (in DuBose's car). #TensingRetrial
  44. The video is over, prosecution resuming questioning of CPD Sgt. Shannon Heine. #TensingRetrial
  45. Heine is showing where Tensing's pants/duty belt were damaged from contact with the ground. #TensingRetrial
  46. Mathews asking if Heine, as a homicide investigator, would've made decisions if something was a homicide. #TensingRetrial
  47. Mathews seems to be trying to get Heine to say if she would've classified Tensing's actions were justified. Pros. objects. #tensingretrial
  48. Mathews now asking about dangerous/high crime parts of town. Heine says Mt. Auburn, where incident occurred, in top 20. #TensingRetrial
  49. Heine: There were some inconsistencies in witness Napier's statement but not enough to discount her statement. #TensingRetrial
  50. Heine: found several bags of marijuana, several homemade remedy type medicines, several cell phones, the bullet casing #TensingRetrial
  51. Heine: Found some prescription meds, some over-the-counter meds. #TensingRetrial
  52. Heine: national trend to delay officer statements so they'll calm down and recollect more. #TensingRetrial
  53. Heine: agrees w Mathews that experts argue about whether officers should see their body cam videos before their statements #TensingRetrial
  54. Prosecution re-direct. Heine: I've never had to use my gun at all. #TensingRetrial
  55. Heine says doesn't recall inconsistencies btwn what Tensing says happened and what video expert shows. (pros says there is) #TensingRetrial
